1. Purpose

These Terms of Use (“ToU”) govern access to and use of the High Tide – Tide chart times mobile application (hereinafter “the App”). By installing, accessing, or using the App, you agree to the ToU. If you do not agree, do not download or use the App.

We may update these ToU from time to time. The “Last updated” date indicates when changes take effect. Continued use of the App after an update constitutes acceptance of the updated ToU. For material changes, we may provide additional notice (e.g., in-app notice), as required by applicable law. The version in force is the one published on our website at the time you use the App.

2. Service description

The App provides coastal-related information and forecasts: tides & currents, wind (speed, gusts, force, direction), waves (height, period, direction), coastal weather (cloud cover, temperature, precipitation, humidity), as well as Sun & Moon phases/times. The App offers charts, timetables, and may provide alerts. It contains advertising and may offer in-app purchases/subscriptions to remove ads and/or unlock advanced features.

Disclaimer: weather/marine data is provided for informational purposes only and may contain errors or delays. Our forecasts are here to help you, but the sea keeps its secrets! For any activity involving your safety (navigation, water sports, etc.), always consult official sources (NOAA, NWS, Met Office, UKHO, BOM, AHO, etc.). The App is not an official navigation or safety service and is not intended for emergency use. Do not rely on the App as your sole source of information for activities involving safety or significant risk.

We may modify, suspend, or discontinue features or data sources at any time, without notice, and without guarantee of availability.

3. Eligibility & Account

The App is rated “Everyone” on Google Play. Minimum age: 13 years. Certain features may require permission to access device services (e.g., location). You must have a compatible Android device and Internet access.

Subscriptions (if any) are managed through Google Play. You are responsible for maintaining the security of your Google account and device, and for any purchases made through your Google account.

4. Requested Android permissions

To function properly, the App requests certain Android permissions. Here is the list as published by app stores (with their purpose):

Approximate location to find nearby tide stations and conditions. (Required for “tides near me” & maps features)

Network access to retrieve weather/marine data.

Connectivity detection to adapt network calls and avoid offline errors.
android.permission.WAKE_LOCK
Prevent the device from going into sleep mode during certain operations (updates/alerts).
com.android.vending.BILLING
In-app purchases/subscriptions via Google Play.
com.google.android.gms.permission.AD_ID
Google advertising ID (advertising measurement and personalization, depending on your settings).
android.permission.ACCESS_ADSERVICES_AD_ID, ACCESS_ADSERVICES_ATTRIBUTION, ACCESS_ADSERVICES_TOPICS
Access to recent Android advertising services (attribution, themes, ID) for displaying and measuring ads on compatible devices.

The above list is provided for information purposes and may change depending on the App version and your Android version.

5. Data & security

According to the Play Store listing, the App may collect: location, in-app activity, and information about the app and its performance; and may share certain categories (e.g., location, app information, and performance) with third parties for purposes described by the publisher. 6. In-app purchases, subscriptions & advertising

The App may contain ads and offer in-app subscriptions to remove advertising and enable features. Conditions, price, duration, and renewal are those indicated in Google Play at the time of purchase. Subscriptions renew automatically unless canceled through Google Play before the renewal date. Trial periods and billing dates are those shown in Google Play at the time of purchase. Prices and subscription terms may change in accordance with Google Play rules and applicable law. Management/cancellation is done via your Google account.

Purchases and refunds are handled by Google Play under its policies. Nothing in these Terms limits any mandatory consumer rights that cannot be excluded under applicable law.

Advertising identifiers (Google AD ID / Android AdServices) may be used for personalization/measurement purposes, subject to your Android and Google privacy settings. You can disable personalized ads in your device settings.

7. Acceptable use conditions

Do not use the App in an illegal, dangerous, or otherwise prohibited manner contrary to the ToU or app store policies.

Do not bypass technical measures, disrupt the service (e.g., automated scraping, overload), or alter displayed data.

Respect third-party rights (data, APIs, maps, official sources).

For any decision involving your safety (navigation, sea outings, crossings, etc.), cross-check information with official sources and local bulletins before acting.

8. Limitation of liability

The service is provided "as is" and "as available"; no explicit or implied warranty is given as to accuracy, completeness, availability, or fitness for a particular purpose.

The publisher cannot be held liable for direct, indirect, incidental, special, or consequential damages resulting from use of the App, including (without limitation) data loss, financial loss, material or bodily harm, including in cases of inaccuracies in tide/weather forecasts.

Weather/tide data may be delayed, incomplete, or incorrect; you agree to use the App at your own risk and to systematically verify with official bodies before any risky activity.

Some features rely on third-party services (including data providers, maps, analytics, and advertising partners). We do not control and do not guarantee the availability, accuracy, timeliness, or completeness of third-party data or services.

We are not responsible for delays or failures caused by events beyond our reasonable control, including outages or failures of third-party services/data providers, internet or platform disruptions, natural disasters, or government actions.

Nothing in these Terms excludes or limits liability to the extent it cannot be excluded or limited under applicable law.

9. Intellectual property & licenses

Third-party trademarks mentioned belong to their respective owners.

You are granted a personal, non-exclusive, non-transferable, and revocable license to use the App in accordance with these ToU.

Except as expressly permitted by law, you may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of the App, nor may you reverse engineer, decompile, or attempt to extract the source code or underlying ideas of the App.

10. Termination

You may stop using the App at any time and uninstall it.

Uninstalling the App does not automatically cancel a subscription. You must manage and cancel subscriptions through your Google Play account.

The publisher may suspend or terminate access to the service in case of violation of the ToU, with prior notice if possible. Any associated data may be deleted.

11. Miscellaneous

Third-party terms & privacy: Your use of the App is also subject to applicable Google Play terms and policies. Our Privacy Policy governs the processing of personal data; if there is a conflict regarding personal data, the Privacy Policy prevails.

Indemnity: You are responsible for your use of the App and agree to indemnify and hold harmless the publisher and its partners from claims arising out of your misuse of the App, violation of these Terms, or violation of any law or third-party rights.

Severability: If any provision is held invalid, the remaining provisions remain in effect.

Law & venue: French law. Courts of Strasbourg have jurisdiction, subject to mandatory consumer protection rules.
