1. Layunin

Ang Terms of Use na ito (“Terms”) ang naggo-govern sa access at paggamit ng High Tide – Tide chart times mobile app (“App”). Sa pag-install, pag-access, o paggamit ng App, ina-accept mo ang Terms. Kung hindi ka sang-ayon, huwag i-install o gamitin ang App.

Puwede naming i-update ang Terms paminsan-minsan. Ang “Last updated” date ang nagsasabi kung kailan effective ang changes. Ang patuloy na paggamit pagkatapos ng update ay nangangahulugang ina-accept mo ang updated Terms. Kapag may major changes, pwede kaming magbigay ng additional notice (hal. in-app notification) kapag required ng law. Ang applicable version ay yung naka-post sa site sa oras ng paggamit mo.

2. Description ng serbisyo

Nagbibigay ang App ng info at forecasts tungkol sa coastline: tides & currents, wind (speed, gusts, force, direction), waves (height, period, direction), coastal weather (clouds, temperature, precipitation, humidity), at Sun & Moon phases/times. May charts, tide times, at pwedeng magbigay ng alerts. May ads at maaaring mag-offer ng in-app purchases/subscriptions para alisin ang ads at/o i-unlock ang advanced features.

Warning: informational lang ang weather/marine data at maaaring may errors o delays. Nandito ang forecasts para tumulong… pero may sariling sikreto pa rin ang dagat! Para sa anumang activity na may safety risk (navigation, water sports, atbp.), i-check palagi ang official sources (hal. PAGASA at local maritime authorities). Hindi official navigation o safety service ang App at hindi ito para sa emergencies. Huwag umasa sa App bilang nag-iisang source para sa high-risk activities.

Puwede naming baguhin, i-suspend, o i-stop ang ilang features o data sources anytime, walang prior notice, at walang guarantee ng availability.

3. Eligibility & account

Ang App ay rated “Everyone” sa Google Play. Minimum age: 13. May ilang features na nangangailangan ng permissions (hal. location). Kailangan mo ng compatible Android device at Internet access.

Ang subscriptions (kung applicable) ay managed via Google Play. Ikaw ang responsable sa security ng Google account mo at device mo, pati sa anumang purchase na ginawa via Google account.

4. Android permissions na hinihingi

Para gumana nang maayos, humihingi ang App ng ilang Android permissions. Narito ang listahan (at purpose) gaya ng nasa stores:

Approximate location para makahanap ng tide stations at nearby conditions. (Needed para sa “tides near me” & maps)
android.permission.INTERNET
Network access para i-fetch ang weather/marine data.
android.permission.ACCESS_NETWORK_STATE & android.permission.ACCESS_WIFI_STATE
Connectivity detection para ma-adapt ang network calls at maiwasan ang offline errors.
android.permission.WAKE_LOCK
Pinipigilan ang device na mag-sleep habang may ilang operations (updates/alerts).
com.android.vending.BILLING
In-app purchases/subscriptions via Google Play.
com.google.android.gms.permission.AD_ID
Google Advertising ID (measurement at personalization, depende sa settings).
android.permission.ACCESS_ADSERVICES_AD_ID, ACCESS_ADSERVICES_ATTRIBUTION, ACCESS_ADSERVICES_TOPICS
Access sa newer Android Ad services (attribution, topics, ID) para magpakita at mag-measure ng ads sa supported devices.

Informational lang ang listahang ito at maaaring magbago depende sa App version at Android version mo.

5. Data & security

Ayon sa Play Store listing, maaaring mag-collect ang App ng: location, in-app activity, at app/performance info; at maaaring mag-share ng ilang categories (hal. location, app info, performance) sa third parties para sa purposes na inilalarawan ng publisher. Encrypted in transit ang data; encrypted at rest ang data sa secure servers. Para sa latest details, tingnan ang “Data Safety” section sa Google Play at ang Privacy Policy.

6. In-app purchases, subscriptions & ads

Maaaring may ads ang App at mag-offer ng subscriptions para alisin ang ads at i-activate ang features. Ang terms, presyo, duration at renewal ay yung nasa Google Play sa oras ng purchase. Auto-renew ang subscriptions maliban kung i-cancel mo via Google Play bago ang renewal date. Ang trial periods at billing dates ay ayon sa ipinapakita sa Google Play sa oras ng purchase. Maaaring magbago ang presyo/terms ayon sa Google Play rules at applicable law. Subscription management/cancellation ay via Google account.

Purchases at refunds ay handled ng Google Play ayon sa policies nito. Wala sa Terms na ito ang maglilimita sa mandatory consumer rights kung applicable.

Advertising identifiers (Google AD ID / Android AdServices) ay maaaring gamitin para sa personalization/measurement depende sa Android/Google privacy settings mo. Pwede mong i-disable ang personalized ads sa device settings.

7. Acceptable use

Huwag gamitin ang App sa illegal, dangerous, o ibang prohibited na paraan na labag sa Terms o sa app store rules.

Huwag i-bypass ang technical measures, huwag guluhin ang service (hal. automated scraping, overload), at huwag baguhin ang displayed data.

I-respeto ang third-party rights (data, APIs, maps, official sources).

Para sa safety-critical decisions (navigation, sea trips, crossings, atbp.), i-cross-check ang info sa official sources at local bulletins bago kumilos.

8. Limitation of liability

Ang service ay provided “as is” at “as available”; walang express o implied warranty tungkol sa accuracy, completeness, availability, o fitness for a particular purpose.

Hindi liable ang publisher sa direct, indirect, incidental, special o consequential damages mula sa paggamit ng App, kabilang (without limitation) data loss, financial loss, property damage o personal injury, lalo na kung may inaccuracies sa tide/weather forecasts.

Maaaring delayed, incomplete o incorrect ang tide/weather data; ina-accept mo na gagamitin mo ang App sa sarili mong risk at i-ve-verify mo palagi sa official agencies bago sa anumang high-risk activity.

May ilang features na naka-depend sa third-party services (data providers, maps, analytics, ad partners). Hindi namin kontrolado at hindi namin ginagarantiyahan ang availability/accuracy/timeliness/completeness ng third-party data/services.

Hindi kami responsible sa delays o failures dahil sa events na beyond our reasonable control, kabilang third-party outages, Internet/platform disruptions, natural disasters, o government decisions.

Walang provision dito ang mag-e-exclude o magli-limit ng liability kung bawal ng applicable law.

9. Intellectual property & licenses

Ang third-party trademarks ay pag-aari ng kani-kanilang owners.

Binigyan ka ng personal, non-exclusive, non-transferable at revocable license para gamitin ang App ayon sa Terms na ito.

Maliban kung pinapayagan ng law, hindi mo pwedeng i-copy, i-modify, i-distribute, i-sell, i-rent, i-sublicense, o gumawa ng derivative works mula sa App; hindi mo rin pwedeng i-reverse engineer, i-decompile, o subukang kunin ang source code o underlying ideas.

10. Termination

Puwede mong itigil ang paggamit ng App anytime at i-uninstall ito.

Ang pag-uninstall ay hindi automatic na nag-ca-cancel ng subscription. Kailangan mong i-manage at i-cancel ang subscriptions via Google Play.

Puwedeng i-suspend o i-terminate ng publisher ang access kung may violation ng Terms, with notice kung possible. Ang associated data ay maaaring ma-delete.

11. Iba pa

Third-party terms & privacy: Ang paggamit mo ng App ay subject din sa applicable Google Play terms/policies. Ang Privacy Policy namin ang naggo-govern sa personal data; kung may conflict tungkol sa personal data, ang Privacy Policy ang masusunod.

Indemnification: Responsable ka sa paggamit mo ng App at sasagutin/ipoprotektahan mo ang publisher at partners laban sa claims na galing sa misuse, violation ng Terms, o violation ng law/third-party rights.

Severability: Kung may provision na ma-declare na invalid, mananatiling effective ang iba.

Governing law & jurisdiction: French law. Courts of Strasbourg ang competent, subject sa mandatory consumer protection rules.
